1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

Agreement: the agreement between TARO ISHIDA and the Customer concerning the purchase of one or more Products through the Online Boutique.

Customer: any natural person visiting the Website and/or purchasing Products through the Online Boutique for personal, non-commercial use, also referred to as “you” or “your”.

Online Boutique: the online shop available through the Website.

Order: an order placed by the Customer for one or more Products through the Online Boutique.

Product or Products: any item offered for sale through the Online Boutique.

TARO ISHIDA: TARO ISHIDA International B.V., a private limited company incorporated under the laws of the Netherlands, with its registered address at Keizersgracht 241, 1016 EA Amsterdam, the Netherlands, registered contact email: info@taro-ishida.com, also referred to as “we”, “us” or “our”.

2. General

2.1

These Terms and Conditions apply to:

  • access to and use of the Website;

  • all offers displayed on the Website;

  • all Orders placed through the Online Boutique; and

  • all Agreements concluded between you and TARO ISHIDA.

By using the Website and/or placing an Order, you agree to be bound by these Terms and Conditions, together with any policies referenced herein. If you do not agree, you must not use the Website or place an Order.

2.2

The most current version of these Terms and Conditions is always available on the Website. We reserve the right to amend these Terms and Conditions at any time by publishing an updated version on the Website. Your continued use of the Website or Online Boutique after such changes have been posted constitutes acceptance of those changes.

2.3

We reserve the right to refuse access to the Website or Online Boutique, or to refuse Orders, at any time and for any lawful reason.

2.4

You understand that information you submit through the Website, other than payment information, may be transferred over various networks and adapted to technical requirements. Payment information is encrypted during transmission.


3. Use of the Online Boutique

3.1

The Online Boutique is intended only for adult natural persons acting in a private capacity and not in the course of trade, business, or profession.

3.2

By using the Online Boutique, you confirm that:

  • you are at least 18 years old;

  • you are purchasing Products for personal, non-commercial use;

  • you will not place false, misleading, or fraudulent Orders;

  • you will keep your login credentials and account details confidential;

  • all information provided by you is current, complete, and accurate.


4. Accuracy of Website Information

4.1

We strive to ensure that all information on the Website is accurate and up to date. However, we do not guarantee that all content is complete, current, or error-free. The content on the Website is provided for general information only and should not be relied upon as the sole basis for decision-making.

4.2

Product images are provided for illustrative purposes. Variations may occur, including differences in colour display depending on your device or screen settings.

4.3

We reserve the right to modify the content of the Website at any time without prior notice. We are under no obligation to update any information on the Website.


5. Offers and Prices

5.1

We reserve the right to change, suspend, discontinue, or withdraw any Product or price at any time without prior notice.

5.2

All offers are non-binding and subject to availability.

5.3

We reserve the right to refuse or limit Orders on a case-by-case basis, including by person, household, geographic region, or jurisdiction, where legally permitted.

5.4

We are not liable for any modification, price adjustment, suspension, or discontinuation of any Product.

5.5

Obvious errors, typographical mistakes, or manifest pricing errors do not bind us.

5.6

If an incorrect price has been published and you have placed an Order based on that price, we will inform you as soon as reasonably possible. You will then have the option to confirm the Order at the correct price or cancel it. If we are unable to contact you, the Order may be cancelled and any payment made will be refunded.

5.7

For deliveries within the European Union, prices are stated inclusive of VAT and, unless otherwise stated, include delivery and return costs.

5.8

For deliveries outside the European Union, prices are stated exclusive of import duties, local taxes, clearance fees, and similar charges in the destination country. Unless otherwise stated, delivery and return costs are included, but local import-related charges remain the responsibility of the Customer.


6. Formation of the Agreement

6.1

An Order is placed when the Customer completes the ordering process through the Online Boutique.

6.2

An Agreement is concluded only once we have accepted and confirmed your Order by email.

6.3

We may impose additional conditions before accepting or performing an Agreement where reasonably necessary, including for verification, fraud prevention, or payment security.

6.4 Pre-orders

Where Products are offered on a pre-order basis, additional conditions may apply and will be stated on the relevant Product page.

Once a pre-order period for a Product has closed and your pre-order has been accepted, changes to that pre-order, including size, style, quantity, or other specifications, may no longer be possible.

After the pre-order period has closed, a pre-order cannot be cancelled except where shipment is unavoidably and materially delayed. In such cases, we will assess cancellation requests in good faith. Any significant production changes, delays, or cancellations will be communicated to you.


7. Shipping Policy

7.1 Processing and dispatch

Regular Orders are generally processed and shipped within 2 to 3 business days after you receive your order confirmation email, unless a different timeframe is stated on the relevant Product page.

Products made from exotic skins may require up to 6 weeks before shipment due to the need to obtain relevant CITES import/export documentation.

You will receive a further notification once your Order has been shipped.

If delivery is delayed or an Order cannot be fulfilled, or can only be fulfilled in part, we will inform you as soon as reasonably possible and, in any event, within 3 business days after the Order was placed. In such circumstances, you will have the right to cancel the Agreement free of charge, and any amount paid will be refunded without undue delay.

7.2 Shipping rates

Unless otherwise stated:

  • shipping is free of charge;

  • exchanges and returns are free of charge.

For Orders delivered outside the EU, TARO ISHIDA does not pay any import duties, taxes, customs charges, or clearance fees imposed by the destination country.

7.3 International shipping

7.3.1

We offer international shipping for eligible Orders and pre-orders.

7.3.2

At this time, we do not ship to the following territories or countries:

Ascension Island, Antarctica, Bouvet Island, Cocos (Keeling) Islands, Cuba, Christmas Island, Western Sahara, Falkland Islands (Malvinas), Equatorial Guinea, South Georgia and the South Sandwich Islands, Heard Island and McDonald Islands, British Indian Ocean Territory, Iran, North Korea, Libya, Nauru, Niue, Saint Pierre and Miquelon, Pitcairn Islands, Sudan, Saint Helena, Somalia, South Sudan, Syria, French Southern Territories, Tajikistan, Tokelau, Yemen, Russia, Ukraine, and Vanuatu.

7.3.3

For non-EU deliveries, Products may be sold without EU VAT where applicable. For VAT-free purchases or questions regarding international billing, please contact support@taro-ishida.com.

7.3.4

Orders shipped outside the EU may be subject to import duties, taxes, customs charges, and clearance fees once the shipment reaches the destination country. These charges are the responsibility of the Customer. TARO ISHIDA is not responsible for such charges and has no control over them.

7.4 Order status

7.4.1

Once your Order has shipped, you will receive a shipping confirmation email including tracking information. Please allow up to 24 hours for tracking updates to become visible.

7.4.2

If you have not received your Order within 7 days after receiving your shipping confirmation email, please contact support@taro-ishida.com and include your name and order number.


8. Payment

8.1

Payment must be made using one of the payment methods offered during checkout and in accordance with any terms applicable to that payment method.

8.2 Pre-orders

For pre-order Products, we may require a 30% deposit at the time the Order is placed. The remaining 70% balance will become due before shipment.

When your Product is ready for dispatch, you will receive an email with payment instructions. Pre-order Products are made available on a limited and advance-sale basis, and the estimated waiting period may be approximately 4 to 6 months from the date of Order. The estimated delivery period will be stated on the relevant Product page.

Failure to pay the outstanding balance within the requested timeframe may result in cancellation of the pre-order.


9. Retention of Title

Ownership of the Products remains with TARO ISHIDA until full payment of all amounts due has been received.


10. Right of Withdrawal

10.1

This clause applies only to Orders for which the Customer has a statutory right of withdrawal under applicable law, including Article 6:230o of the Dutch Civil Code.

This right does not apply to Products made to your specifications or clearly personalised for you. Such Orders cannot be cancelled under the statutory right of withdrawal once confirmed by us.

10.2

Where applicable, you have the right to withdraw from the Agreement within 14 days without giving any reason.

The withdrawal period expires 14 days after:

  • the day on which you, or a third party designated by you, acquires physical possession of the Product; or

  • in the case of multiple Products in one Order delivered separately, the day on which you, or a third party designated by you, acquires physical possession of the final Product.

10.3

During the withdrawal period, you must handle the Products and packaging with due care. You may inspect the Products only to the extent necessary to establish their nature, characteristics, and fit, as you would in a physical boutique.

In particular, please note that the black outsole of our shoes is delicate and must remain in original, unmarked condition for a return to be accepted. Shoes must only be tried on indoors, on a clean and carpeted surface, and with any protective sticker still in place until you have decided to keep them.

10.4

To exercise your right of withdrawal, you must notify us within the withdrawal period by email at support@taro-ishida.com.

10.5

After notifying us, you must return the Product promptly in accordance with the return instructions and shipping label provided by us.

10.6

Returned Products must be sent back:

  • with all accessories;

  • in the original packaging;

  • in original, unused, and resaleable condition, subject only to handling permitted under the statutory right of withdrawal.

10.7

We reserve the right to reject a return or reduce the refund where the Product has been used beyond what is necessary to inspect it, or where the return conditions set out in this clause have not been met.

10.8

The burden of proving timely and correct exercise of the right of withdrawal rests with you.

10.9

Once we have received and inspected the returned Product, we will process the refund within 14 days. We may withhold reimbursement until we have received the Product back or you have supplied evidence of return, whichever occurs first.

Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed.

10.10

If an Order is returned to TARO ISHIDA due to the Customer’s failure to pay customs charges, import duties, taxes, or clearance fees, failure to accept delivery, failure to sign for a shipment where required, or for any similar reason attributable to the Customer, the free shipping and returns policy will not apply.

In such cases, TARO ISHIDA may deduct from the refund any shipping charges, return costs, customs handling costs, and other reasonable expenses incurred.

TARO ISHIDA is not responsible for and will not refund Orders confiscated, abandoned, or destroyed by customs where the Customer has failed to comply with import requirements or refused customs charges. You are responsible for checking whether footwear may lawfully be imported into your country.


11. Faulty Products

11.1

We are committed to maintaining high quality standards. Each Product is inspected before shipment. If you believe a Product is defective, please contact support@taro-ishida.com as soon as possible and preferably within 5 days of delivery, including:

  • a description of the alleged defect;

  • clear photographs and/or video;

  • the order number;

  • proof of purchase.

11.2

We may request that the Product be returned for inspection before determining the appropriate remedy.

11.3

If a defect is confirmed, we may, at our discretion and depending on the circumstances:

  • repair the Product;

  • replace the Product, subject to availability; or

  • provide a full or partial refund.

11.4

We may reject claims relating to:

  • normal wear and tear;

  • misuse, accident, improper storage, or improper care;

  • damage caused by the Customer or third parties;

  • natural characteristics of the materials or artisanal production methods that do not constitute a defect.

11.5

Where a Product is confirmed to be faulty, we will reimburse the purchase price, original delivery costs, and any reasonable return shipping costs incurred by you.


12. Product Care

12.1

The black outsoles of our shoes will naturally wear with use. This is normal wear and tear and does not constitute a manufacturing defect.

12.2

We recommend consulting a professional leather specialist or qualified shoemaker for specific care advice.

12.3

To preserve the condition of your Products, we recommend that you:

  • keep leather surfaces clean and dry using a soft dry cloth;

  • store Products away from direct light and heat;

  • protect Products from rain, moisture, and abrasive surfaces;

  • store Products in the original TARO ISHIDA box or dust bag when not in use.


13. Limitation of Liability

13.1

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be unlawful.

13.2

Subject to clause 13.1, TARO ISHIDA shall be liable only for direct losses that are a reasonably foreseeable consequence of our breach of the Agreement.

13.3

To the extent permitted by law, our total liability under any Agreement shall be limited to the greater of:

  • EUR 100, or

  • the total amount paid by you for the relevant Order.

13.4

We are not liable for indirect loss, consequential loss, loss of profit, loss of opportunity, or losses caused by third parties, except where such limitation is not permitted by applicable law.


14. Complaints

Complaints, other than complaints regarding allegedly faulty Products under clause 11, may be submitted by email to support@taro-ishida.com.

We aim to respond within 2 working days.


15. Third-Party Links

15.1

The Website may contain links to third-party websites or services not operated by us. We do not control and are not responsible for the content, accuracy, policies, or practices of such third parties.

15.2

Your use of any third-party websites is at your own risk. We recommend reviewing their terms and privacy policies before engaging with them.


16. Comments, Feedback and Other Submissions

16.1

If you submit ideas, comments, suggestions, proposals, or other materials to us, whether requested by us or not, you agree that we may use, reproduce, edit, publish, translate, distribute, and otherwise exploit such materials in any medium, without restriction and without compensation, unless otherwise agreed in writing.

16.2

We reserve the right, but not the obligation, to monitor, edit, or remove content that we consider unlawful, offensive, defamatory, obscene, infringing, or otherwise objectionable.

16.3

You confirm that any materials you submit:

  • do not infringe the rights of any third party;

  • are not unlawful, abusive, defamatory, or misleading;

  • do not contain malware, viruses, or harmful code.

You remain solely responsible for any submissions you make.


17. Personal Data

Your submission of personal data through the Website is governed by our Privacy Policy.


18. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.


19. Applicable Law and Jurisdiction

These Terms and Conditions, and any Agreement concluded between you and TARO ISHIDA, are governed exclusively by Dutch law.

Any disputes shall be submitted to the competent court in the Netherlands, without prejudice to any mandatory rights you may have under applicable consumer law.
